These terms apply to all visitors, customers, and anyone who contacts us or uses our services in New Braunfels, TX and the surrounding service area.
H&M New Braunfels Concrete Works provides concrete contracting services including but not limited to driveway installation, patio construction, sidewalk building, slab foundation work, stamped and decorative concrete, retaining walls, pool decks, concrete steps, garage floors, footings, and related concrete services in New Braunfels, TX and the surrounding region.
Services are provided by appointment. We do not accept walk-in clients at our business address. All service arrangements are confirmed in writing or by phone.
Estimates are provided in writing after a site visit and assessment. An estimate is not a binding contract until both parties have signed a written agreement or work order. Estimates are based on conditions observed at the time of assessment and are subject to change if conditions differ materially from what was observed.
Factors that may cause price adjustments include unforeseen site conditions, changes in material costs, changes to project scope requested by the customer, or permits requiring additional work. Any changes to the original scope that affect cost will be communicated to and agreed upon by the customer before work proceeds.
Estimates provided by phone or email without a site visit are preliminary and non-binding. A final written estimate requires an on-site assessment.
Work dates are confirmed by mutual agreement. We make every effort to adhere to the agreed schedule. We reserve the right to reschedule due to weather conditions, material availability, or other factors outside our control. We will provide advance notice of any rescheduling when possible.
If you need to cancel or postpone a scheduled project, please contact us as early as possible. Cancellations made after materials have been ordered or work has begun may result in charges for materials, labor, and other costs already incurred. The specific cancellation terms will be outlined in the written agreement for your project.
Payment terms are set out in the written agreement or work order for each project. Unless otherwise stated in writing, a deposit may be required before work begins, with the remaining balance due upon completion of the project. Accepted payment methods will be communicated at the time of agreement.
Payments not received by the due date may be subject to late charges as specified in the written agreement. We reserve the right to suspend or discontinue work on a project if payment obligations are not met. In the event of non-payment, we reserve the right to pursue all available legal remedies, including the filing of a mechanic's lien on the property where work was performed, as permitted under Texas law.
The customer is responsible for providing clear and safe access to the work site, marking or disclosing the location of underground utilities, sprinkler systems, or other underground features before work begins, and ensuring that any required HOA approvals or permits not handled by us are obtained in advance.
Failure to disclose known site conditions that affect the work may result in additional charges and will relieve us of responsibility for damages resulting from that failure.
We stand behind our work. Any warranty terms specific to a project will be stated in the written agreement for that project. In general, we will address workmanship defects that arise from our installation within a reasonable period following project completion, as defined in the written agreement.
Warranty coverage does not extend to damage caused by improper use, failure to follow care instructions, soil movement or settlement beyond normal tolerances, acts of nature, or modifications made by anyone other than our crew. Concrete is a natural material and minor surface variations, hairline cracks, and color variation are normal and are not considered defects.
Manufacturer warranties on materials, if any, are passed through to the customer but are governed by the manufacturer's terms, not ours.
To the maximum extent permitted by applicable law, H&M New Braunfels Concrete Works shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services or this website. Our total liability for any claim arising out of or related to services provided shall not exceed the amount paid by the customer for the specific service giving rise to the claim.
We are not liable for delays, damages, or losses caused by factors outside our reasonable control, including weather events, material shortages, acts of third parties, or utility or infrastructure issues.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action arising under these terms shall be brought exclusively in the courts of Comal County, Texas.
We may update these Terms and Conditions at any time. When we do, we will update the effective date at the top of this page. Your continued use of this website or our services after changes are posted constitutes acceptance of the updated terms.
